CIRCUIT BENCH AT JALPAIGURI 20.01.2025. C.R.M. (A) 949 of 2024 27/tkm In Re : An application for anticipatory bail under section 438 of the Code of Criminal Procedure in connection with Pundibari P.S case no.

of dated 18.1.2024 under sections 365/376D/323/109 IPC And In Re : Sanjit Dhar @ Mahadeb Dhar @ Sansit Dhar ...petitioner Mr. Ananda Paul ...for the Petitioner Mr. Saikat Chatterjee Mr. Chattu Roy ...for the State Mr. Swarup Das ...for the de facto complainant 1.

Heard learned lawyers for the parties.

2.

We have considered the material on record.

Statement of the victim implicates the petitioner in the gang rape. He does not stand on the same footing with coaccused Sarala Dhar who has been granted anticipatory bail. In view of the gravity of offence and prima facie involvement of the petitioner therein, we are not inclined to grant anticipatory bail to him.

3.

Accordingly, prayer for anticipatory bail is rejected. (Gaurang Kanth, J.) (Joymalya Bagchi, J.)
