Learned advocate for the petitioner submits that the petitioner is in custody for about 40 days and he was implicated in a case for alleged offences being committed in the year 2021. Mr. Luksom, learned advocate appearing on behalf of the State submits that the petitioner has handed over a fake appointment letter. However, the learned advocate for the State is unable to satisfy this court as to when the Investigating Officer last interrogated the accused in jail. So far as the fake appointment letter is concerned, the Investigating Agency is in the process of assessing regarding its veracity.

Having considered the submissions advanced on behalf of the parties and the period of detention of the present petitioner, the

application for bail of the present petitioner is allowed. Accordingly, the present petitioner shall be released on bail upon furnishing a bond of Rs.10,000/-(Rupees ten thousand only) with two sureties of like amount each, one of whom must be local, subject to the satisfaction of the learned Chief Judicial Magistrate, Jalpaiguri.

It is clarified so far as the local surety is concerned, the learned Chief Judicial Magistrate, Jalpaiguri will insist on depositing of a title deed of a property which would be within the jurisdiction of the learned Chief Judicial Magistrate, Jalpaiguri.

If on bail, the present petitioner shall meet with the Investigating Officer of the case once in a week till submission of the chargesheet. With the aforesaid observations, the application for bail being CRM (SB) 19 of 2023 is disposed of.
