The State of West Bengal In Re: - An appeal under Section 374(2) of the Code of Criminal Procedure.

1. The instant appeal has been filed beyond the statutory period of limitation provided therefor.

2. When the matter appeared on 03.01.2024, there was no representation behalf of the appellant. The Coordinate Bench after noticing the fact that there is a delay of 517 days in filing the instant appeal without an application for condonation of delay directed the matter to be listed in the next Circuit Bench.

3. Today when the matter is taken up, there is no representation on behalf of the appellant. It appears that the appellant is not interested in pursuing the instant appeal otherwise as well. Moreover, the instant appeal has been filed beyond the statutory period of limitation without seeking condonation of delay.
