Case No. 131/2024 dated 18.10.2024 under Sections 85/117(2)/109(1) of B.N.S. and read Sections 3/4 of the Dowry Prohibition Act.
And In the matter of: Kanak Barman ....Petitioner Mr. Sudip Guha ...for the Petitioner Mr. Saikat Chatterjee, Mr. Chattu Roy ...for the State The petitioner is the husband. The petitioner prays for anticipatory bail on the ground that there are no specific allegations against the petitioner. The first incident took place four months prior to the date of the complaint. Learned Advocate for the State opposes the prayer for anticipatory bail and submits there are serious allegations that the petitioner tried to strangulate his wife. The petitioner allegedly threatened the wife for divorce and when she refused, he had committed the offence.

The investigation is going on.
Considering the submissions and upon perusal of the medical documents as also the fact that the investigation is at its initial stage, we are not inclined to grant anticipatory bail. Accordingly, the prayer for anticipatory bail is rejected. (Partha Sarathi Chatterjee, J.) (Shampa Sarkar, J.)
