Learned advocate appearing for the petitioners submits that the petitioner no.1 is the mother-in-law, petitioner no.2 is the brother-in-law and petitioner no.3 is wife of the brother-in-law of the deceased who has been implicated on the basis of the accusations made by the father of the deceased. Learned advocate submits that marriage was solemnized eight years prior to the unfortunate incident and the main accusations are against the husband and the petitioners have been implicated in connection with the instant case as they are inmates of the matrimonial home.

Learned advocate for the State produces the Case Diary and draws the attention of the Court to the statement of the

witnesses which includes the father of the deceased as also the neighbours.

On overall assessment of the materials appearing against the present petitioners, I am of the view that their custodial detention may not be warranted in connection with the instant case. Accordingly, the prayer for anticipatory bail of the petitioners is allowed.

As such, I direct that in the event of arrest, the petitioners be released on bail upon furnishing a bond of Rs.20,000/- (Rupees Twenty Thousand only), with two sureties of Rs. 10,000/- (Rupees Ten Thousand only) each, one of whom must be local to the satisfaction of the investigating officer/arresting officer of the case and also subject to the conditions as laid down under Section 438(2) of the Cr.P.C. and/or under Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023.

Accordingly, CRM (A) 942 of 2025 is allowed.

All parties shall act in terms of server copy of the order downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
