Case No. 1252/2020 dated 19.10.2020 under Section 6 of the Protection of Children from Sexual Offences Act, 2012.

Mishra, Mr. Manaj Saha ...for the petitioner Mr. Tapan Bhattacharjee, Mr. Sanjiv Das ...for the State The petitioner prays for bail on the ground of prolonged incarceration. He is in custody for four years. There is no chance of early conclusion of trial.

The de facto complainant is present before the Court. Learned Advocate for the State opposes the prayer for bail on the ground that the serious allegations have been levelled against the petitioner.

Considering the materials on record, the statement of the victim recorded under Section 164, Cr.P.C., the nature of the allegation levelled against the petitioner and the age of the victim, we are not inclined to grant bail to the petitioner. Accordingly, the prayer for bail is rejected.

The learned trial court is requested to expedite the trial. The prosecution is directed to cooperate with the trial and produces the witnesses accordingly.
