Petitioners Mr. Abhilash Mittal ... for the petitioners Mr. Abhijit Sarkar, Mr. Sanjiv Das ... for the State The petitioners pray for anticipatory bail on the ground that they have been falsely implicated. The co-accused has been granted bail. The nature of injury is simple and the incident did not occur.
Learned Advocate for the State hands over the case diary and opposes the prayer for anticipatory bail. We have perused the injury report. We find that the incident took place in the presence of direct evidence. Thus, the custodial interrogation for the petitioners would not be necessary. Accordingly, the prayer for anticipatory bail is allowed. Accordingly, we direct that in the event of arrest, the petitioners shall be released on bail upon furnishing a bond of Rs.10,000/- each, with two sureties of equal amount each, to the
satisfaction of the arresting officer. The petitioners shall appear before the investigating officer, Matigara police station once in a week until further orders. The petitioners shall not leave the jurisdiction of Matigara police station till completion of the investigation. The petitioners will not tamper with evidence and shall not intimidate witnesses.
