And In the matter of: Jiskel Rava @ Jeskel Rabha .... petitioner Mr. Hillol Saha Podder ... for the petitioner Ms. Namrata Das ... for the State Learned counsel for the petitioner contends that the petitioner admittedly had an amorous relationship with the alleged victim. The husband of the petitioner learnt about the same subsequently and did not approve of the same. As a result, the victim committed suicide, for which the petitioner is now sought to be incriminated. Learned counsel for the State opposes the prayer for anticipatory bail and submits that several independent witnesses gave their statements under Section 161 of the Code of Criminal Procedure which indict the petitioner to the effect that the petitioner, taking advantage of the amorous relationship, had been circulating nude photographs of the victim, which were in his possession, on social media.

The petitioner was allegedly blackmailing the victim, which ultimately resulted in her suicide.

The investigation is not yet over and, as such, it is submitted that the petitioner ought not to be granted anticipatory bail. Upon hearing the respective versions of the parties, we are convinced that in the event anticipatory bail is granted at this premature juncture, the same might affect the investigation adversely. Accordingly, we are inclined to dismiss the application. Hence, CRM (A) 789 of 2022 is dismissed.
