1. Learned advocate representing the petitioner prays for bail on the ground that the investigation is complete and he has been in custody for more than 48 days.

2. Learned advocate for the State opposes the prayer of the petitioner and produces the case diary. He refers to certain prescriptions.

3. Considering the materials on record, the fact that investigation is complete and the charge-sheet (C/S No.492 of 2024, dated November 30, 2024) has been submitted, we are inclined to release the petitioner on bail.

4. Accordingly, we direct that the petitioner shall be released on bail upon furnishing a bond of Rs.10,000/- with two sureties of equal amount each, one of whom must be local, to the satisfaction of learned Additional Chief Judicial Magistrate,

Mathabhanga, subject to the condition that the petitioner shall appear before the learned Trial Court on each and every date of hearing until further orders of the said court and shall not intimidate witnesses or tamper with evidence in any manner whatsoever or commit similar offences in future. The petitioner shall not enter into the jurisdiction of the Sitalkuchi Police Station and furnish his local address to the concerned officer-in-charge of the police station within whose jurisdiction he will henceforth reside.

5. In the event the petitioner fails to comply with the conditions as stated hereinabove, the trial court shall be at liberty to cancel his bail in accordance with law without further reference to this Court.
