(NDPS) 566 of 2025 In Re : An Application for bail under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 filed in connection with Pradhan Nagar Police Station Case No. 789 of 2023 dated 30.09.2023 under Sections 21(c)/22(c)/27A/29 of the Narcotic Drugs and Psychotropic Substances Act.

Bail prayer of the petitioners was turned down by this Court on several occasions considering the merits of the case. The 2nd petitioner seeks bail primarily on medical grounds. Learned counsel for the State opposes the prayer. It appears that though the 2nd petitioner appears to be medically unstable, his treatment is being arranged by the correctional home regularly. In the event the said petitioner requires any surgery as submitted by the learned counsel for the petitioners, the Superintendent of the Correctional Home shall take necessary steps in this regard.

By an order passed on 30th June, 2025 rejecting the bail prayer of the petitioners, a co-ordinate Bench of this Court directed the learned Special Judge to conclude the trial of the case as early as possible preferably within one year from date. The present application appears to be pre mature. Considering the material on record, the prayer for bail is rejected at this stage.

The application being CRM(NDPS) 566 of 2025 is disposed of.
