In the previous order of the coordinate Bench there are directions to be made upon the trial court to complete the trial within a specific period of time, which is not complied with as yet.
It is submitted that, as a matter of fact, the trial court is over burdened with the case dockets.
It is also submitted that in this matter charge-sheet has already been filed after completion of investigation. The petitioner is in custody for a considerable period of time. Be that as it may, considering the facts and circumstances of the case, the bail of the petitioner is granted.
Accordingly, the petitioner, namely, Atarul Hossain @ Atarul Hossen, shall be released on bail upon furnishing a bond of Rs.10,000/- ( Rupees Ten Thousand) with two sureties of like amount each, one of whom must be local, to the satisfaction of the Chief Judicial Magistrate, Cooch Behar, subject to the condition that the petitioner shall appear before the trial court on each and every date of hearing and shall not, directly or indirectly, make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade such person from disclosing such facts to the court or to any police officer or tamper with evidence in any manner whatsoever. This application, being CRM (DB) 471 of 2022, is disposed of.
