Mr. Satarudriya Mukherjee, Mr. Saptarshi Kar, Ms. Oshmita Mukherjee.

...for the Petitioner.

Mr. Saikat Chatterjee, Mr. Chattu Roy.

.....for the State.

1. Heard the learned Advocates for the parties.

2. We have considered the materials on record. It is contended victim had committed suicide at the petitioner's residence. Statements of witnesses show there was a romantic relationship between them. Victim had not left behind any suicide note.

3. Keeping in mind the aforesaid facts, we are of the opinion possibility of false implication out of suspicion cannot be ruled out. Custodial interrogation of the petitioner is not necessary.

4. Hence, we are inclined to grant anticipatory bail to the petitioner.

5. Accordingly, we direct that in the event of arrest the petitioner shall be released on bail upon furnishing a bond of Rs.10,000/- with two sureties of like amount each, to the satisfaction of the arresting officer and subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure, 1973 and on further condition that the petitioner shall appear before the jurisdictional court and pray for regular bail within a period of four weeks from date.
