Court No.3.

Rakib In the High Court at Calcutta Circuit Bench at Jalpaiguri Criminal Miscellaneous Jurisdiction CRM (A) 949 of 2025 In Re: An Application for Anticipatory Bail under Section 438 of the Code of Criminal Procedure, 1973/Under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023 in connection with Pundibari Police Station Case No. 867 of 2023 dated 07.12.2023 under Sections 20(b)(ii)(c)/25/28/29 of the Narcotic Drugs & Psychotropic Substances Act, 1985.

And In the matter of : Rokeya Khatun.

......Petitioner.

Mr. Hillol Saha Podder ......for the Petitioner.

Mr. Nilay Chakraborty, Ld. APP, Mr. Saikat Chatterjee ......for the State.

Learned advocate appearing for the petitioner submits that petitioner is the owner of the vehicle from where there has been seizure of commercial quantity of contraband. It has been submitted by the learned advocate that the petitioner is innocent of the charges and was not aware regarding the contraband being carried.

Learned advocate appearing for the State has produced the Case Diary, shown the seizure list and the fact that the petitioner is registered owner of the vehicle.

Having considered the quantum of contraband seized, I am of the opinion that this is not a fit case for extending the privilege of anticipatory bail to the petitioner. Accordingly, CRM (A) 949 of 2025 is dismissed. All parties shall act in terms of server copy of the order downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
