1. The report of the learned District Judge indicates that the records of Title Suit No.50 of 1997, which is pending before the learned Civil Judge, Senior Division, Jalpaiguri Sadar Court is untraceable. It is submitted that the original suit was registered as OC Suit No.50 of 1997.

2. The District Judge, Jalpaiguri has asked for a month's time to trace out the records, but as the petitioners appear to be in an urgent need to have the matter decided, the petitioners shall approach the learned Trial Judge for reconstruction of the

records. The learned Trial Judge shall permit the same.

3. Accordingly, the writ petition is disposed of.

4. The parties are directed to act on the basis of the server copy of this order.
