Petitioner is a Stage Carriage Permit holder in connection with his vehicle being no.

WB71B9825 in connection with which vide order dated 25th October, 2024 Secretary, Regional Transport Authority, Jalpaiguri issued Provisional Time Table permitting permit holder to ply the vehicle following such time table. It is also contended that time table has been issued provisionally for a period of two months commencing from 25th October, 2024 and the last date would be 25th December, 2024.

Grievance of the petitioner is Jaigaon United Bus Owners' Association and Birpara Dooars Motors Owners' Association being respondent nos. 11 and 10 respectively are insisting upon the petitioner to tweak time schedule as granted in favour of the petitioner vide order dated 25th October, 2024 to accommodate other existing Stage Carriage Permit holders.

It is contended on behalf of the petitioner that since Provisional Time Table has already been issued by the Secretary, Regional Transport Authority, Jalpaiguri respondent nos. 10 and 11 are not empowered to change such time table according to their own convenience for the benefit of other Stage Carriage Permit holders.

State respondents are represented by learned advocate.

However, in spite of service of notice, respondent nos. 10 and 11 are not represented. Taking note of the grievance ventilated by the petitioner as well as Provisional Time Table dated 25th October, 2024 which will expire on 25th December, 2024;

Secretary, Regional Transport Authority, Jalpaiguri being respondent no. 2 is directed to hear the petitioner and respondent ns. 10 and 11 or their representatives before 24th December, 2024 and pass an

appropriate order relating to time table which is required to be followed by the petitioner on and from 25th December, 2024. Such order to be passed by the respondent no.2 shall be communicated to the parties by seven days thereafter.

With the aforesaid directions, writ petition stands disposed of.

There shall be, however, no order as to costs. Urgent photostat certified copy of the order, if applied for, be given to the parties, upon usual undertakings.
