Ganesh Ray v. The State Of West Bengal
02.04.2025 Item no. 03.
Court No.1.
S.De (Rejected) Calcutta High Court In the Circuit Bench at Jalpaiguri CRM (A) 988 of 2024 In the matter of : Ganesh Ray.
...Petitioner.
Mr. Sushil Paswan, ......for the Petitioner.
Mr. Abhijit Sarkar, Mr. Tapan Bhattacharjee, ...for the State.
1.
The petitioner says that although the vehicle from which 223 kgs. of Ganja was seized, is still registered in his name, in fact, he sold the vehicle to one Mr. Raju in March 2023. He has no connection with the contraband items. He has been falsely implicated. He prays for pre-arrest bail.
2.
Learned State counsel strongly opposes the prayer. 3.
I find from the records that on January 22, 2025, a coordinate Bench had granted interim protection to the petitioner by directing that he shall not be arrested in connection with this case for six weeks or until further orders whichever is earlier on condition that he shall cooperate with the investigation and report to the Investigating Officer once in a week until further orders. 4.
Learned State advocate tells me that the petitioner never co-operated with the investigation nor reported to the
Investigating Officer. That order was not extended subsequently.
5.
In view of huge quantity of Ganja being involved and given that the vehicle from which recovery was made is still registered in the name of the petitioner, keeping in mind the restrictions in Section 37 of the NDPS Act, I am not inclined to entertain the petitioner's prayer for anticipatory bail.
6.
CRM (A) 988 of 2024 is dismissed.
