Petitioner(s) Mr. Sudip Guha ... for the petitioner(s) Mr. Sagnik Sankar Sikdar ... for the State-respondent(s) Learned advocate for the petitioner submits that he has been falsely implicated in connection with the instant case and the information to the police authorities was submitted at a belated stage which do not rule out the possibility of manufacturing the case being established against the present petitioner.

Learned advocate for the State, on the other hand, opposes the prayer for bail and draws the attention of the court to the statement of the victim under Section 183 of the BNSS before the learned Judicial Magistrate.

I have taken into account the nature of the accusations. Although, the same are not encouraging but custodial detention of the present petitioner may not be warranted in the facts and circumstances of the case. Hence, the prayer for anticipatory bail of the petitioner is Allowed.

Accordingly, I direct that in the event of arrest, the petitioner be released on bail upon furnishing Rs.20,000/- (Rupees Twenty Thousand only), with two sureties of Rs.10,000/- (Rupees Ten Thousand only) each, one of whom must be local, to the satisfaction of the arresting officer of the case and also subject to the conditions as laid down under Section 438(2) of the Cr.P.C. and/or under Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023. If on bail, the petitioner shall meet with the Investigating Officer of the case once in a week till further orders of this court and shall stay outside the jurisdiction of Dhupguri Police Station and Banarhat Police Station. However, for the limited purposes of attending the investigating officer of the case, the petitioner may be allowed to enter the jurisdiction of Dhupguri Police Station. Accordingly, CRM(A) 958 of 2025 is disposed of. Pending application(s), if any, is also disposed of.
