Report has been submitted by Mr. Banerjee, learned advocate appearing for the state which has been prepared by the Officer-in-Charge, Kharibari Police Station, Darjeeling.

Report reflects that the petitioner and his family members could not reach at the police station because they were not in the vicinity of the said police station for reasons which have been stated in the writ petition.

Be that as it may, police authorities have already in their report stated that there is no possibility of any untoward incident taking place and

neither any incident took place earlier. However since the petitioner apprehended danger to his life and approached this court and earlier a direction was passed, I further direct that in case the petitioners within the course of this week approaches the police station, the police authorities as earlier directed will ensure and take steps in accordance with law so that the life and liberty of the petitioners are protected when the petitioner and/or his family members enter and stay at the residence.

With the aforesaid observations WPA 2610 of 2024 is disposed of.

Report so submitted be kept with the record.

A copy of the report be handed over to the learned advocate appearing for the petitioner. All parties shall act on the server copy of this order duly downloaded from the official website of this Court.
