Learned advocate appearing for the petitioners submits that there has been an amicable settlement between the petitioners and the private opposite party no.2. Records reflect that there was a matrimonial discord pursuant to which Women P.S. Cooch Behar Case No. 106 of 2023 was registered at the instance of the opposite party no.2. The case was registered under Sections 498A/354/323/506/34 of the Indian Penal Code read with Sections 3/4 of the Dowry Prohibition Act. Subsequently charge-sheet was submitted under the same provisions.

In course of pendency of the proceedings before the Court, the parties settled their disputes. Consequent to which Matrimonial Suit No. 213 of 2025 was filed before the learned District Judge, Cooch Behar under Section 28 of the Special Marriage Act, 1954 for dissolution of marriage by way of mutual consent.

On the basis of the aforesaid contention, report was called for. The Officer-in-Charge, Women Police Station, Cooch Behar has submitted a report enclosing a statement which has been recorded by an officer of the said police station. The contents of the statement reflect that an amicable settlement has taken place and the de facto complainant and the petitioner no.4 have decided to part their ways in life.

Having considered the changed circumstances and the fact that an amicable settlement has been arrived at between the parties, the genesis of which relates to a matrimonial dispute and discord, I am of the opinion that further continuance of the proceedings arising out of Women Police Station Cooch Behar Case No. 106 of 2023 corresponding to G.R. Case No. 1519 of 2023 and the charge-sheet submitted therein before the learned Chief Judicial Magistrate, Cooch Behar be hereby quashed.

Consequently, the revisional application being CRR 585 of 2025 is allowed.

Report submitted by the learned advocate appearing for the State enclosing the statement of the opposite party no.2 be kept with the record.

All concerned parties shall act on the server copy of this order duly downloaded from the official website of this Court.

Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
