Govinda@Gobinda Sarkar v. The State Of West Bengal
09.01.2026 Item no. 06.
Court No.3.
Rakib In the High Court at Calcutta Circuit Bench at Jalpaiguri Criminal Miscellaneous Jurisdiction CRM (A) 966 of 2025 In Re: An Application for Anticipatory Bail under Section 438 of the Code of Criminal Procedure, 1973/Under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023 in connection with STF Siliguri Police Station Case No. 05 of 2025 dated 26.09.2025 under Sections 20(b)(ii)(c)/25/29 of the Narcotic Drugs and Psychotropic Substances Act.
And In the matter of : Govinda @ Gobinda Sarkar.
......Petitioner.
Mr. Sourav Sarkar ......for the Petitioner.
Mr. Aditi Shankar Chakraborty, Ld. APP Mr. Abhijit Sarkar Ms. Namrata Das ......for the State.
Learned advocate appearing for the petitioner submits that petitioner is not a resident of the address from where 11 kgs of ganja were recovered and he has been falsely implicated in connection with the instant case, as such his liberty may not be curtailed.
On the other hand learned advocate appearing on behalf of the State submits that initially there was recovery of 256 kgs of ganja/contraband, pursuant to the statement of the arresting accused another 11 kgs of ganja were recovered from the house of the present petitioner. Further there are Call Date Records as well
as multiple monetary transactions between the arrested accused and the present petitioner.
Having considered the materials available in the Case Diary, I am of the opinion that this is not a fit case for granting the privilege of anticipatory bail to the petitioner. Consequently, the prayer for anticipatory bail of the petitioner in CRM (A) 966 of 2025 is dismissed. All parties shall act in terms of server copy of the order downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
