Petitioner(s) Mr. Hillol Saha Podder ... for the petitioner(s) Mr. Tapan Bhattacharjee Mr. Chattu Roy ... for the State-respondent(s) Learned advocate appearing for the petitioners submits that the petitioners have been falsely implicated in connection with the instant case for alleged demand of dowry. The petitioners are the father-in-law and mother-inlaw of the injured. Learned advocate for the State has produced the case diary and submits that the statement reflects that both the petitioners are involved in assaulting the injured/ daughter-in-law.

I have taken into account the statement before the doctor which reflects that the assault was inflicted by the mother-in-law and the husband.

Having considered the same, I am of the view that the prayer for anticipatory bail of the petitioner no.2 (Mafiya Khatun Bibi @ Mofiya Bibi) is to be rejected. However, the prayer for anticipatory bail of the petitioner no.1 (Majidul Mia @ Majidur Hossain) should be allowed.

Hence, the prayer for anticipatory bail of the petitioner no.1 (Majidul Mia @ Majidur Hossain) is Allowed. Accordingly, I direct that in the event of arrest, the petitioner no.1 (Majidul Mia @ Majidur Hossain) be released on bail upon furnishing Rs.20,000/-(Rupees Twenty Thousand only), with two sureties of Rs.10,000/- (Rupees Ten Thousand only) each, one of whom must be local, to the satisfaction of the arresting officer of the case and also subject to the conditions as laid down under Section 438(2) of the Cr.P.C. and/or under Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023.

Accordingly, CRM(A) 967 of 2025 is Partly Allowed. Pending application(s), if any, is also disposed of. Parties to act on a server copy of this order duly collected from the official website of the Hon'ble High Court, Calcutta.
