For the Petitioners Since the petitioners seek expeditious disposal of Misc Case no. 06 of 2020 pending before the learned Civil Judge, Junior Division, First Court, Jalpaiguri, the matter may be considered without service of notice upon the opposite parties. The opposite parties shall not be prejudiced by an order directing expeditious disposal of the case. Learned counsel for the petitioners submits that an ex parte order was passed against the petitioners on 9th August, 2016 in Title Suit no. 254 of 2011.

The petitioners filed an application under Order IX Rule 13 of the Code of Civil Procedure for setting aside the said order. The misc. case is pending.

In view of the above, learned Civil Judge, Junior Division, First Court, Jalpaiguri is directed to take the Misc. case to its logical conclusion within six months from the next date of hearing

fixed before him without granting any unnecessary adjournment to either of the parties, in accordance with law.

C.O. 223 of 2024 is disposed of.
