The petitioner is a retired employee of a primary school. She retired from service on 31st January, 2020. She is yet to receive her terminal dues.
It appears that the Sub-Inspector of School, Jalpaiguri, Sadar East Circle vide a communication dated 16th March, 2023 requested the petitioner to comply the objections raised against her service book by the DPPG. The petitioner submits that the objection raised by the DPPG was duly answered.
A representation was, thereafter, made by the petitioner through the learned advocate in the month of September 2023 requesting release of the terminal dues. The said representation is yet to be responded.
Learned advocate representing the State respondents submits, upon instructions from the District Inspector of School (PE), Jalpaiguri that, vide Memo No. 144/PEN/JPG dated 12th May, 2023, the petitioner was requested to produce original of certain documents and to submit attested photocopies of the same. The petitioner received the communication on 15th May, 2023 but till date did not submit the documents as sought for.
The petitioner is directed to comply the objections as raised by the DPPG communicated to the petitioner vide communicating memo of the District Inspector of School (PE), Jalpaiguri on 12th May, 2023.
The respondent authority is directed to do the needful and take steps for releasing the terminal dues of the petitioner immediately upon receipt of the documents as sought for.
A copy of the communicating memo dated 12th May, 2023 has been handed over to the learned advocate for the petitioner in Court today by the learned advocate appearing for the State respondents. The writ petition stands disposed of.
Urgent certified photo copy of this order, if applied for, be supplied to the parties expeditiously on compliance of usual legal formalities.
