Versus

The State of West Bengal & Ors.

Mr. Sumit Kumar, Mr. Pretom Das, .....for the State

1. The writ petition is disposed of with the direction upon the District Inspector of School, Cooch Behar, to treat the writ petition as a representation of the petitioner and pass a reasoned order upon hearing the petitioner, any other authority and the school. If it is found that the petitioner is eligible for Category - A scale, then necessary order shall be passed. The said scale shall be disbursed to the petitioner. The decisions of the High Court can be relied upon by the petitioner.

2. If it is found that the petitioner is not eligible, such reasons shall be reflected in the order.

3. The reasoned order shall be communicated to the petitioner. The entire exercise shall be completed within a period of 8 weeks from the date of communication of this order.

4. There shall be no order as to costs.

5. Parties are directed to act on the basis of the server copy of this order.
