1. Affidavit-of-service filed in Court today is taken on record.

2. The petitioner alleges inaction on the part of the police in taking steps in response to the complaint lodged by him before the Siliguri Police Station.

3. On a perusal of the writ petition, it appears that the complaint allegedly filed by the petitioner before the Siliguri Police Station is not annexed.

4. A compliant dated 10th December, 2025 before the Commissioner of Police, Siliguri Police Commissionerate, however, is annexed to the writ petition.

5. Learned advocate representing the State respondents has obtained instruction from the Siliguri Police Station wherein it is clearly mentioned that the writ petitioner neither visited nor submitted any complaint before the Siliguri Police Station.

6. On receipt of a communication from the Commissioner of Police, Siliguri Police Commissionerate, the police entrusted one SubInspector of Police to cause an enquiry and submit a report.

7. The enquiry officer contacted the petitioner over telephone but the petitioner intimated the police that he was out of Siliguri and will meet the enquiry officer after returning to Siliguri.

8. The aforesaid fact was diarised in the Siliguri Police Station vide GDE No. 1064 dated 22nd December, 2025.

9. The complaint of the petitioner is still at the enquiry stage.

10. As it appears that even though the petitioner did not make a formal complaint before the Siliguri Police Station but the complaint made before Commissioner of Police, Siliguri Police Commissionerate is being enquired into by the police.

11. The petitioner is directed to cooperate with the enquiry officer. In the event any cognizable offence is detected, then necessary steps shall be taken by the police in accordance with law.

12. The writ petition stands disposed of.

13. Urgent photostat certified copy of this order, if applied for, be given to the parties, upon compliance of necessary formalities.
