13.01.2026 Item no. 17.
Court No.3.
Rakib In the High Court at Calcutta Circuit Bench at Jalpaiguri Criminal Miscellaneous Jurisdiction CRM (A) 983 of 2025 In Re: An Application for Anticipatory Bail under Section 438 of the Code of Criminal Procedure, 1973/Under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023 in connection with Sitalkuchi Police Station Case No. 544 of 2024 dated 18.11.2024 under Sections 20(a)(i) of the Narcotic Drugs and Psychotropic Substances Act.
And In the matter of : Bidhan Das ......Petitioner.
Ms. Riya Agarwal ......for the Petitioner.
Mr. Nilay Chakraboryt, Ld. APP Mr. Biswarup Roy ......for the State.
Learned advocate appearing for the petitioner submits that the case of the petitioner do not fall within the rigors of Section 37 of the NDPS Act.
Learned advocate appearing for the State submits that the issues have already been canvassed and the earlier order of rejection in CRM (A) 148 of 2025 reflects that the learned Court after considering the materials and observing that the land where cultivation has been carried out belongs to the petitioner rejected the prayer for anticipatory bail.
I find no change of circumstances in the present case.
Accordingly, the prayer for anticipatory bail of the petitioner in CRM (A) 983 of 2025 is dismissed. All parties shall act in terms of server copy of the order downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
