Roy ... for the petitioner(s) Mr. Niloy Chakraborty Mr. Sagnik Sankar Sikdar ... for the State-respondent(s) Learned advocate for the petitioner submits that the victim is a major and had a relationship with the petitioner. Learned advocate also submits that the case has been falsely instituted so far as the present petitioner is concerned.

I have perused the statement under section 164 of the Cr.P.C./Section 183 of the BNSS which has been relied upon by the learned advocate appearing on behalf of the State and I find that there was force used by the present petitioner and there is accusation that the petitioner married twice earlier.

Having considered the background and the facts of the case, I am of the opinion that this is not a fit case to grant anticipatory bail to the petitioner.

Hence, the prayer for anticipatory bail of the petitioner is rejected.

Accordingly, CRM(A) 987 of 2025 is dismissed. Parties to act on a server copy of this order duly collected from the official website of the Hon'ble High Court, Calcutta.
