Since the innocuous prayer of the petitioners is for expeditious disposal of G.R. case no. 1962 of 2012 pending before the learned Chief Judicial Magistrate, Jalpaiguri, the matter may be considered without service of notice upon the opposite parties. The opposite parties shall not be prejudiced by an order directing expeditious disposal of the case.
It appears that charge sheet was submitted on 26th October, 2012 and charges were framed on 3rd March, 2015. Charge sheeted witness no.1 has been partially examined on 23rd August, 2016 and since then there has been no further progress in trial. In view of the above, the learned trial Court is directed to take the proceeding to its logical conclusion within six months from the next date of hearing fixed before him, without granting any unnecessary adjournment to either of the parties, in accordance with law.
CRR 495 of 2024 is disposed of.
