The present revisional application was preferred challenging the continuance of G.R. Case No. 1337 of 2024 arising out of New Jalpaiguri Police Station Case No. 245 of 2024 dated 20.03.2024 under Sections 498A/325/506 of the Indian Penal Code. The petitioner also preferred an application expressing that an amicable settlement and compromise has been arrived at between the petitioner and the private opposite party no.2. To that effect attention of the Court was drawn to an order dated 20.12.2024 when a coordinate Bench of this Court was pleased to direct the State to submit a report enclosing the statement of the private opposite party no.2.

Today the learned advocate for the State has submitted a report which reflects the statement/letter of Dipshika Ghosh, the opposite party no.2 wherein the lady has in a letter communicated to the Inspector-in-Charge of New Jalpaiguri Police Station for withdrawal of the case as she

and her husband are staying together. Let the said report be kept with the record.

Having considered the changed circumstances, I am of the view that further continuance of the proceedings may harm the relationship which has revived between the petitioner and the opposite party no.2. Accordingly, all further proceedings relating to G.R. Case No. 1337 of 2024 arising out of New Jalpaiguri Police Station Case No. 245 of 2024 dated 20.03.2024 under Sections 498A/325/506 of the Indian Penal Code including the charge-sheet, if any, are hereby quashed.

Consequently the revisional application being CRR 499 of 2024 along with CRAN 1 of 2024 is allowed. All concerned parties shall act on the server copy of this order duly downloaded from the official website of this Court.

Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
