Learned advocate for the State has produced the Case Diary and drawn the attention of the court to the statement under Section 183 of the BNSS of both the defacto-complainant and her minor daughter.
I have perused the statement.
Having regard to the nature of the accusation and that there are case and counter case between the parties, I am of the view that the petitioner be extended the privilege of anticipatory bail on certain stringent conditions. Hence, the prayer for bail of the petitioner is Allowed.
Accordingly, I direct that in the event of arrest, the petitioner be released on bail upon furnishing Rs.20,000/- (Rupees Twenty Thousand only), with two sureties of Rs.10,000/- (Rupees Ten Thousand only) each, one of whom must be local, to the satisfaction of the arresting officer of the case and also subject to the conditions as laid down under Section 438(2) of the Cr.P.C. and/or under Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023. The petitioner shall inform the Inspector-in-charge and/or Officer-in-charge of the Bhaktinagar Police Station and shall stay outside the jurisdiction of the said police station on and from 10.01.2026. The petitioner shall also once in a week for a period of next three months meet with the Inspector-in-charge of the Bhaktinagar Police Station or any other officer deputed by him and for such limited purpose he would enter the jurisdiction of Bhaktinagar Police Station.
Accordingly, CRM(A) 988 of 2025 is disposed of.
