The present revisional application was preferred challenging the continuance of G.R. Case No. 1336 of 2024 arising out of New Jalpaiguri Police Station Case No. 244 of 2024 dated 20.03.2024 under Sections 341/323/506/34 of the Indian Penal Code. The petitioner also preferred an application expressing that an amicable settlement and compromise has been arrived at between the petitioner and the accused/opposite party no.2. To that effect attention of the Court was drawn to an order dated 20.12.2024 when a co-ordinate Bench of this Court was pleased to direct the State to submit a report enclosing the statement of the private opposite party no.2.
Today the learned advocate for the State has submitted a report which encloses the statement of the opposite party no.2 viz. Sujit Dey which reflects that there was a matrimonial discord from which the case arose and subsequently there has been a settlement and both the
husband and the wife are staying together. Let the said report be kept with the record.
Having considered the changed circumstances, I am of the view that further continuance of the proceedings may harm the relationship which has revived between the petitioner and the opposite party no.2. Accordingly, all further proceedings relating to G.R. Case No. 1336 of 2024 arising out of New Jalpaiguri Police Station Case No. 244 of 2024 dated 20.03.2024 under Sections 341/323/506/34 of the Indian Penal Code are hereby quashed.
Consequently the revisional application being CRR 501 of 2024 along with CRAN 1 of 2024 is allowed. All concerned parties shall act on the server copy of this order duly downloaded from the official website of this Court.
Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
