IN THE CIRCUIT BENCH AT JALPAIGURI

CRM (A) 990 of 2025 In re : An Application under Section 482 of the BNSS, 2023/under Section of the Cr.P.C.

in connection with Kotwali (Coochbehar) PS Case No. 643 of 2024 dated 26.06.2024 u/s 406/409 of the IPC, 1860.

-AndIn the matter of : Deepak Barman @ Dipak Barman ... Petitioner(s) Mr. Subhasish Misra Mr. Satyajit Paul Mr. Rounak Ghosh ... for the petitioner(s) Mr. Nilay Chakraborty, APP Mr. Biswarup Roy ... for the State-respondent(s) Learned advocate appearing for the petitioner submits that the petitioner is innocent of the charges and he has been falsely implicated in connection with the instant case.

Learned advocate for the State, on the other hand, produces the case diary and submits that substantial materials have been collected.

I have considered the materials appearing in the case diary and I find that in a nationalized bank, the petitioner - Clerk-cum-cashier of the said bank, has

misappropriated huge amount of money of the customers. There are materials also to substantiate the accusations. Having considered the same, I am of the view that this is not a fit case for extending the privilege of anticipatory bail to the petitioner.

Hence, the prayer for anticipatory bail of the petitioner is Rejected.

Accordingly, CRM(A) 990 of 2025 is dismissed. Parties to act on a server copy of this order duly collected from the official website of the Hon'ble High Court, Calcutta. Urgent Photostat certified copy of this order, if applied for, be supplied to the parties subject to compliance with all requisite formalities.
