The petitioners seek transfer of the legal proceeding pending before the Court of Darjeeling to anywhere in Siliguri or Jalpaiguri as the petitioners allege that they are not getting legal assistance from the lawyers in the courts of Darjeeling.

Learned advocates representing the respondents oppose the prayer of the petitioners. It has been submitted that an order has already been passed by the learned Court below refusing the prayer of the petitioners seeking transfer.

This Court is of the opinion that as the petitioners' prayer seeking transfer of the subject cases has already been refused, accordingly, it will be open for the petitioners to challenge the same in accordance with law.

The writ petition stands disposed of.

Affidavit of service filed in the Court today is taken on record.

Urgent certified photocopy of this order, if applied for, be supplied to the parties expeditiously on compliance of usual legal formalities.
