Learned advocate appearing for the petitioner submits that petitioner has been implicated in connection with the instant case on the basis of statement of co-accused and there has no recovery from the possession of the present petitioner. On the other hand learned advocate for the State opposes the prayer for anticipatory bail and submits that a motor vehicle was found wherein the address reflects that of Sitalkuchi and the same belongs to the petitioner.
Having considered the materials appearing against the present petitioner, I am of the opinion that the custodial detention of the present petitioner may not be warranted in the facts of the
present case. As such the prayer for anticipatory bail of the petitioner is allowed.
Accordingly, I direct that in the event of arrest, the petitioner be released on bail upon furnishing a bond of Rs.20,000/- (Rupees Twenty Thousand only), with two sureties of Rs. 10,000/- (Rupees Ten Thousand only) each, one of whom must be local to the satisfaction of the investigating officer/arresting officer of the case and also subject to the conditions as laid down under Section 438(2) of the Cr.P.C. and/or under Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023.
As the charge-sheet has already been submitted this order of anticipatory bail will remain in force for a period of eight weeks.
Accordingly, CRM (A) 993 of 2025 is allowed.
All parties shall act in terms of server copy of the order downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
