The petitioner, a retired clerk of a high school, exercised his option for switching over to GPF from CPF Scheme.

The learned Advocate for the petitioner submits that though the petitioner exercised such option within the cut off date but the entire amount which the petitioner was required to refund for such switching over but could not be deposited within the cut off date.

It appears from the record that the petitioner submitted a representation before the respondent authority for allowing the petitioner to switch over to 9/the CPF Scheme by extending the date of refund of the Government share in terms of GO 749-SE(L) dated 13.06.20214.

The prayer of the petitioner for extension of the date of refund of the Government share appears

to have been forwarded by the District Inspector of Schools (SE) Jalpaiguri to the Deputy Secretary, School Education Department (Secondary Branch) vide memo dated 19th January, 2022.

Learned Advocate appearing for the State submits that no decision has yet been taken by the Deputy Secretary in this regard.

In view thereof, WPA 2781 of 2023 is disposed of by directing the Deputy Secretary, School Education (Secondary Branch) being the 3rd respondent to take a decision on the prayer of the petitioner for extension of the date of refund of the Government share as expeditiously as possible but positively within a period of four weeks from the date receipt of a server copy of this order.

Affidavit of service filed in court be kept with the record.
