In The High Court at Calcutta In the Circuit Bench at Jalpaiguri 03.01.2025 CRM (DB) 725 of 2024 Sws.M/ct. 1 sl no. 73 In Re: An application for bail under Section 483 of the B.N.S.S., 2023 arising out of Ghoksadanga Police Station Case No. 579 of 2024 dated 22.10.2024 under section 126(2)/124(2) of the Bhartiya Nyay Sanhita, 2023.

And In the matter of: Himesh Ranjan Barman ...... petitioner allowed Ms. Mousumi Das ...... for the petitioner Mr. Kollol Acharjee Mr. Tapan Bhattacharjee ...... for the State Heard the parties.

Considering the facts and the available materials on record, and the fact that the petitioner is in custody since 20.10.2024 and investigation is at advanced stage. Further detention of petitioner for investigation is not seems necessary. As such, we are inclined to grant bail to the petitioner.

The prayer for bail stands allowed.

Accordingly, the petitioner, namely, Himesh Ranjan Barman shall be released on bail upon furnishing a bond of Rs.10,000/- with two sureties of like amount each, one of whom must be local, to the satisfaction of the learned Additional Chief Judicial Magistrate, Mathabhanga, Coochbehar subject to condition that he shall not leave the jurisdiction of the concerned police station and

shall report to the Officer-in-charge of the concerned police station once in a week until further orders.

The petitioner shall also appear before the Trial Court on every date of hearing until further orders and shall not intimidate witnesses or tamper with evidence in any manner whatsoever or commit similar offences in future.

In the event petitioner fails to appear before the Trial Court without any justifiable cause, the Trial Court shall be at liberty to cancel his bail in accordance with law without further reference to this Court.

In view of the above, the application for bail being CRM(DB) 725 of 2024 stands disposed of.
