Learned advocate appearing for the petitioners as well as the private opposite party is present.

Learned advocate appearing for the petitioner is aggrieved by the fact that the application for interim maintenance till date has not been disposed, although the case under Section 125 of Cr.P.C, was filed in the year 2024. It has also submitted that for diverse reasons the present case is pending and there is no progress in the case.

Learned advocate appearing for the opposite party submits that interim maintenance has been granted under the relevant provisions of the Protection of Women from Domestic Violence Act, 2005.

Having considered the fact that date has been fixed on 30th March, 2026 for service return and the learned advocate

appearing for the opposite party has already entered appearance before this Court. It would be presumed in case the opposite party is absent on the next date, that knowingly the opposite party is not participating in the proceedings, as such the learned Magistrate would proceed with the application for interim maintenance and dispose of the same within a period of three months from 30th March, 2026.

With the aforesaid observations CRR 599 of 2025 is disposed of.

All parties shall act in terms of server copy of the order downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
