Petitioner prays for expeditious disposal of CR Case No. 370 of 2023 pending before the learned Judicial Magistrate, 3rd Court, Jalpaiguri.
Report reflects that the case was sent for mediation which also did not materialise and the accused persons had been seeking adjournment which is delaying the proceedings. Learned advocate appearing for the petitioner submits that till date the amount of interim compensation which was granted by the learned Magistrate has also not been deposited or paid by the accused/opposite party. Although the case was initiated in the year 2023 but till date the substance of the accusation has not been read over to the accused and as such the trial of the case could not commence.
It has been submitted that on different pretext the accused opposite party is seeking adjournment. In view of the aforesaid, I direct that all possible steps be taken by the learned Magistrate by way of fixing at least
one date in a month so that the trial of the case can be taken to its logical conclusion within a reasonable period of time. In case any execution case is filed by the complainant for recovery of the interim compensation, separate dates be fixed by the learned Magistrate and both the dates should not be clubbed.
All efforts be taken to conclude the trial as directed above at the earliest.
With the aforesaid observations CRR 517 of 2024 is disposed of.
All concerned parties shall act on the server copy of this order duly downloaded from the official website of this Court.
