1. Having considered the averments made in the application being CRAN 1 of 2025, order dated 3.1.2025 is recalled. The application is restored to its original file and number.
2. CRAN 1 of 2025 is disposed of.
3. Heard learned lawyers for the parties. Petitioner is in custody for 660 days. Co-accused Javed has been enlarged on bail. He stands on the same footing. Hence, we are inclined to extend the same privilege to the petitioner also.
4. Accordingly, the petitioner be released on bail upon furnishing a bond of Rs.10,000/- with two sureties of like amount each, one of whom must be local to the satisfaction of the learned Judge, Special Court under NDPS Act Kalimpong on condition that the petitioner shall appear before the trial court on every date of hearing and shall not
intimidate witnesses or tamper with evidence in any manner whatsoever.
5. In the event he fails to appear before the trial court without justifiable cause, the trial court shall be at liberty to cancel his bail automatically without reference to this court.
6. The application being CRM (NDPS) 579 of 2024 is disposed of.
