18.02.2026 Item No.27 Ct.No.6 b.das Rejected
IN THE HIGH COURT AT CALCUTTA
CIRCUIT BENCH AT JALPAIGURI CRIMINAL MISCELLANEOUS JURISDICTION C.R.M. (R) 72 of 2025 In Re : An application for bail under Section 439 of the Code of Criminal Procedure read with Section 483 of the Bharatiya Nagarik Suraksha Sanhita, in connection with Bhaktinagar Police Station Case No. 1094 of 2025 dated 06.11.2025 under Sections 64(1)/123/351(2) of BNS. And In Re :
Phurba Lama @ Amit Lama ... Petitioner Mr. Sachin Subhas Mr. Subrata De ... for the Petitioner Mr. Ujjwal Luksom Mr. S. S. Sikdar ... for the State Report submitted by the State is taken on record. None appears for the victim despite service.
Heard learned counsels for the parties.
The petitioner is in custody for more than 100 days and submits that he has been falsely implicated and no incident as alleged occurred at all. There is also inordinate delay in lodging of complaint.
Learned counsel for the State opposes the prayer. I have considered the material on record.
The medical report of the victim prima facie corroborates her contention. The petitioner appears to be a content writer and allegedly called the victim to his house.
He offered spurious drink to the victim, as a result of which the victim became unconscious. Taking advantage of the same, he allegedly ravished her.
The allegations are extremely serious in nature. Considering the material on record, prayer for bail is rejected at this stage.
The application being CRM (R) 72 of 2025 is disposed of.
Case Diary be returned.
Urgent certified website copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
