Circuit Bench at Jalpaiguri C.R.M.(DB) No. 679 of 2023 In Re:- An application for bail under Section 439 of the Code of Criminal Procedure in connection with Mekhliganj Police Station Case No. 378 of 2022 dated 16.11.2022 under Sections 366A/377 of the Indian Penal Code read with Sections 3/5 of the Immoral Traffic Prevention Act.

Learned Counsel for the petitioner submits he has surrendered before the trial court in terms of the direction passed by the Hon'ble Apex Court in Special Leave to Appeal (CRL) No. 10736 of 2023. He is in custody for 79 days. He prays for bail.

Learned Counsel for the State opposes the prayer for bail and submits petitioner is involved in a racket of trafficking victims for sexual exploitation.

We have considered the materials on record.

Statements of the witnesses including a minor victim show petitioner was involved in trafficking them for sexual exploitation. Offence has severe social consequences. Release of the petitioner on bail may have adverse impact on the victims who are likely to be won over. Under such circumstances we are not inclined to grant bail to the petitioner.

4. Application for bail is, thus, rejected.
