Circuit Bench at Jalpaiguri C.R.M.(DB) No. 683 of 2023 In Re:- An application for bail under Section 439 of the Code of Criminal Procedure in connection with Alipurduar Police Station Case No. 311 of 2023 dated 20.09.2023 under Sections 392/395 of the Indian Penal Code read with Sections 25(1))(a)/27 of the Arms Act.

And In Re : Nur Islam Hoque @ Kankata .... petitioner Mr. Supritam Nag ....for the petitioner Mr. Ujjwal Luksom Mr. Sourav Ganguly ...... for the State 1.

Learned Counsel for the petitioner submits he is in custody for 32 days. It is also submitted he is no way connected with the dacoity. He prays for bail.

Learned Counsel for the State opposes the prayer for bail and submits stolen articles and firearm were recovered from his possession.

We have considered the materials on record. Stolen articles and firearm have been recovered from the possession of

the petitioner. Investigation is in progress. Under such circumstances we are not inclined to grant bail to the petitioner.

4. Application for bail is, thus, rejected.
