Learned advocate appearing on behalf of the petitioners submits, upon instruction that, a communication has been made by the petitioners to the learned advocate-on-record not to press the writ petition seeking liberty to file fresh writ petition upon proper and better particulars.

The respondents are represented.

On perusal of the written communication signed by all the petitioners and on perusal of the Vakalatnama filed along with the writ petition it appears that the petitioner no. 1, Joga Mahato put his LTI in the Vakalatnama but has allegedly put his

signature in the written communication to the learned advocate-on-record.

On a query from the Court learned advocate Mr.

Sankar Nath Mukherjee representing the petitioners submits, upon instruction that, the signature of Joga Mahato as appearing in the written communication dated January 28, 2024 has been made by the son of Joga Mahato as Joga Mahato is seriously ill.

As the learned advocate has taken responsibility and submitted before this Court that all the petitioners including Joga Mahato do not intend to proceed with the instant writ petition, accordingly, the writ petition stands dismissed as 'not pressed'. Liberty given to the petitioners to file fresh writ petition upon proper and better particulars. The hand written instruction dated January 28, 2024 given by the petitioners to the learned advocate be retained with the records.

Urgent certified photocopy of this order, if applied for, be supplied to the parties expeditiously on compliance of usual legal formalities.
