Dhanraj Barman v. The State Of West Bengal And ANR
IN THE HIGH COURT AT CALCUTTA
CIRCUIT BENCH AT JALPAIGURI 13.12.2023. C.R.M. (A) 979 of 2023 18/tkm In Re : An application for anticipatory bail under section 438 of the Code of Criminal Procedure in connection with Dinhata Women PS case no. 80 of 2021 dated 30.9.2021 under section 8 of the POCSO Act and In Re : Dhanraj Barman ... petitioner Mr. Swarup Das Mr. S Paul ...... for the petitioner Mr. A S Chakraborty, ld APP Mr. Biswarup Roy ...... for the State 1.
This is a subsequent application for anticipatory bail. It is contended charge sheet has been filed after the rejection of pre-arrest bail. We are of the considered view submission of charge sheet is an incriminating and not an extenuating circumstance which would justify the subsequent prayer for anticipatory bail. There are sufficient materials implicating the petitioner in the offence of sexual assault on the minor. He had absconded and processes have been issued against him for his apprehension.
2.
Hence, the subsequent application for pre-arrest bail is rejected.
