Mr. Prosenjit Mukherjee learned advocate appears on behalf of the petitioners on the virtual mode and submits that the petitioners have communicated with the advocate-on-record and expressed their intention not to proceed with the writ petition any further.

Sankar Nath Mukherjee, learned advocate represents the petitioners in Court today and produces a written communication allegedly signed by the petitioners on January 28, 2024 expressing their intention not to proceed with the writ petition.

On a perusal of the signatures made in the Vakalatnama and the signatures made in the written communication dated January 28, 2024 it appears that a couple of signatures do not tally with each other.

Mr. Sankar Nath Mukherjee learned advocate take responsibility of the petitioners and submits that they have already expressed their desire not to proceed with the writ petition and intends to file fresh writ petition independently upon proper and better particulars.

Upon hearing the submissions made on behalf of the petitioners by Mr. Sankar Nath Mukherjee and by Mr. Prosenjit Mukherjee learned advocates, the instant writ petition stands dismissed as 'not pressed'.

It will be open for the petitioners to file independent writ petitions upon proper and better particulars, if so advised.

The hand written instruction dated January 28, 2024 given by the petitioners to the learned advocate be retained with the records.

Urgent certified photocopy of this order, if applied for, be supplied to the parties expeditiously on compliance of usual legal formalities.
