13.12.2023 7 IN THE HIGH COURT AT CALCUTTA Sdas rejected Circuit Bench at Jalpaiguri CRM (DB) 689 of 2023 In Re:- An application for bail under Section 439 of the Code of Criminal Procedure in connection with Falakata Police Station Case No. 85 of 2020 dated 04.03.2020 under Sections 498A/304B of the Indian Penal Code.

And In Re : Dilip Mandal ......petitioner Mr. Arijit Ghosh Mr. Satyajit Pal ...... for the petitioner Mr. Kallol Acharjee Mr. Arjun Choudhury ...... for the State 1.

Learned Counsel for the petitioner submits co-accused are on bail. He prays for bail.

2.

Learned Counsel for the State opposes the prayer for bail and submits victim lady was subjected to torture over dowry. She committed suicide within four months of marriage.

3.

We have considered the materials on record. Parents of the principal accused have been granted bail/anticipatory bail. Petitioner is the husband of the victim lady. Demand of dowry was made upon the victim lady. She committed suicide within four months of marriage. Keeping in mind the gravity of the offence and

the principal role of the petitioner in the crime, we are not inclined to grant bail to the petitioner at this stage. 4.

Application for bail is, thus, rejected.
