Chakraborty, APP Mr. Nilay Chakraborty, APP Dr. Arjun Chowdhury ... for the State-respondent(s) Learned advocate for the petitioner submits that he has been implicated in connection with the instant case on the basis of statement of a co-accused and he is innocent of the charges, as such, on any stringent condition, he may be enlarged on anticipatory bail.
Learned Additional Public Prosecutor, on the other hand, opposes the prayer for anticipatory bail and submits that there are call data records at the relevant point of time
and the petitioner also happens to be the owner of the vehicle which was carrying the contraband.
Since the amount seized in connection with the instant case is of commercial quantity and the complicity of the present petitioner cannot be ruled out because of the materials available in the case diary, I am not inclined to extend the privilege of anticipatory bail to the present petitioner.
Hence, the prayer for anticipatory bail of the petitioner is Rejected.
Accordingly, CRM(A) 1005 of 2025 is dismissed. Parties to act on a server copy of this order duly collected from the official website of the Hon'ble High Court, Calcutta.
