The grievance of the petitioners is that no steps for holding of the election has been taken in spite of the fact that the tenure of the Board expired on February 26, 2023.

Mr. Basu, learned Advocate for the petitioners submits that the petitioners have made a representation before the Secretary, Cooperative Election Commission dated November 3, 2023 requesting the said respondent to initiate steps for holding of election for constitution of the Board of Directors of the Cooperative Bank.

None appears for the 3rd respondent in spite of notice.

Since the tenure of the Board expired on February 26, 2023 steps are to be taken for holding

election for constitution of the Board of Directors at the earliest.

In view thereof, this Court directs the Secretary, Cooperative Election Commission being the 3rd respondent and the Special Officer, Cooch Behar Cooperative Agriculture and Rural Development Bank Limited being the 6th respondent to take steps for holding the election for constitution of the Board of Directors and to conclude the same as expeditiously as possible but positively within a period of six months from the date of receipt of a server copy of this order.

With the above direction WPA 2873 of 2023 is disposed of.
