It is found from the record that on 4th January, 2024, though none appeared on behalf of the petitioner, this court has directed the Commissioner, Siliguri Municipal Corporation, being the second respondent to file a report with regard to the allegations contained in the writ petition. The petitioner was directed to serve the copy of the writ petition upon Mr. Dhar, who is appearing for the Siliguri Municipal Corporation.

Today when the matter is called, Mr. Dhar, Learned Advocate appearing for the Siliguri Municipal Corporation, submits that the petitioner has not served the copy of the writ application and as such, it is not possible for the Siliguri Municipal Corporation

to submit report in compliance with the order passed on 4th January, 2024.

Considered the submission made by the counsel for the Siliguri Municipal Corporation.

This court finds that today when the matter is called, none appears on behalf of the petitioner and no accommodation is sought for.

In view of the above, WPA 2875 of 2023 is dismissed for default.
