The grievance of the petitioner is that no steps have been taken by the Police Authorities on the basis of the written complaint of the petitioner. Mr. Paul, learned advocate appearing for the State submits that on the basis of the written complaint of the petitioner an FIR was lodged vide Sitalkuhi PS case no. 109 of 2021 dated 8.5. 21 under Sections 341/323/325/326/307/354/506/34 of the Indian Penal Code and files a report dated January 2, 2024. From the said report it appears that during investigation the Investigating Officer examined the complainant and other available witnesses and recorded their statements under Section 161 of the Criminal Procedure Code. After
completion of investigation, charge-sheet has been submitted being Sitalkuchi P.S. Charge-sheet no. 29/2022 dated 8.5.2023 under Sections 341/323/325/326/307/354/506/34 of the Indian Penal Code.
Upon going through the report dated January 2, 2024 of the Officer-in-Charge, Sitalkuchi Police Station, it appears that the respondent Authorities have taken steps on the basis of the complaint of the petitioner. Therefore, the allegation of Police inaction is without any basis.
Let such report be kept with the record.
With the above observations, WPA 2887 of 2023 stands disposed of.
